When I read about Trump being indicted for paying off stormy Daniels, all I can think of is Robert De Niro as Al Capone in the 1987 film The Untouchables. After all his crimes, they got Capone on tax evasion. I am not choosy. I will take what I can get.

Or the NY case breaks the dam. It's always easier to be second or third once a precedent is established. Also, I suspect that Trump has a glass jaw.
It seems that in order to get a felony conviction, Brag has to show that a federal crime was committed, otherwise it is just a misdemeanor. And in this instance there isn't much precedence (a state prosecutor proving a federal crime). The fear is that an acquittal would strengthen Trump.
Maybe the Cohen conviction provides a roadmap?

A US judge on Friday rejected Donald Trump’s effort to exclude an Access Hollywood tape of him making vulgar comments about women from a defamation lawsuit by the writer E. Jean Carroll, who says the former president raped her in the mid-1990s.
Carroll sought to introduce an excerpt from the tape, which was recorded in 2005 and where Trump boasted about forcing himself on women, as evidence that Trump had a propensity for sexual assaults comparable to hers.
US District Judge Lewis Kaplan in Manhattan said that while propensity evidence is ordinarily not admissible, a reasonable jury could find that Trump admitted in the tape “that he in fact has had contact with women’s genitalia in the past without their consent, or that he has attempted to do so”.

If the Manhattan DA can't convict Trump on the same evidence that sent Cohen to jail it'll be just pain absurd. I just realized as I wrote the last two words in the previous sentence that I was stealing from Mose Allison's "Everybody's Cryin' Mercy." the last verse follows and if folks don't know the song, it is well worth a listen.

I just saw an interview of Lisa Rubin, an attorney, and David Cay Johnston, a journalist, where it was explained how Brag can still prosecute Trump for a felony without reference to federal law. In fact, it appears there are multiple ways this can happen so I feel relieved.

I'm hoping that the announcement of an indictment takes place on the Ides of March - which is unlikely given that Cohen is testifying in the afternoon, but still it is possible - so that there would be a nice historical resonance to the whole thing.
